To place orders and access certain features of our website, you must create an account. When creating an account, you agree to:

You are responsible for all activities that occur under your account, whether or not you authorized such activities.

Order Acceptance

All orders are subject to acceptance by Javamate Coffee Roasters. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity.

Pricing

All prices are listed in US Dollars and are subject to change without notice. We strive to ensure all pricing information is accurate, but errors may occur. If we discover an error in the price of products you have ordered, we will contact you.

Payment

Payment is required at the time of order. We accept major credit cards through our secure payment processor, Stripe. By providing payment information, you represent that you are authorized to use the payment method.

We currently ship only within the United States and the State of Ohio. Shipping costs and delivery times are as specified on our Shipping Policy page.

Risk of loss and title for products pass to you upon delivery to the shipping carrier. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

You must provide accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer.

We stand behind the quality of our coffee. If you are not satisfied with your purchase, please contact us within 30 days of receipt.

Due to the perishable nature of coffee and food safety regulations, we cannot accept returns of opened coffee products. However, we will work with you to resolve any quality issues.

Refunds, when approved, will be processed using the original payment method within 5-10 business days.

The website and its original content, features, and functionality are and will remain the exclusive property of Javamate Coffee Roasters and its licensors.

The website is protected by copyright, trademark, and other laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.

Our website may allow you to post, link, store, share and otherwise make available certain information, text, graphics, or other material ("User Content").

You are responsible for User Content that you post to the website, including its legality, reliability, and appropriateness. By posting User Content, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such content.

You retain any and all of your rights to any User Content you submit, post or display on or through the website and you are responsible for protecting those rights.

You may not use our website or services:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others

We do not warrant that the website will be constantly available, or available at all, or that the information on this website is complete, true, accurate, or non-misleading.

In no event shall Javamate Coffee Roasters, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising out of or relating to the use of or any inability to use any portion of the website or otherwise under these terms, whether in contract, tort, or otherwise, is limited to the greater of: (a) the amount you have paid to us in the 12 months prior to the event giving rise to the liability, or (b) $100.

You agree to defend, indemnify, and hold harmless Javamate Coffee Roasters and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

We may terminate or suspend your account and bar access to the website immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the website or contact us to request account deletion.

These Terms shall be interpreted and governed by the laws of the State of Ohio, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
